~ ilt, SECTtC~N 26. (a) The rights of the city of <br />Portsmouth in and to its water front, wharf property, public lan~thags, <br />~aarves, docks, streets, avenues, pa~s, bridges and other public places~ <br />mad its gas, water and electric wor~,s, shall not be sold, except by a <br />resolution passed by a recorded affirmative vote of three-finn~ths of all <br />t_he members elected to the cotmcil. <br /> <br /> (b) Before selling any such property, and before granting any <br />franchise, privilege, lease, or right of any kind to use any public prop- <br />erty or easement of any descriptic~, except in the case of and for a <br />trunk rail~y, the city shall first, after due advertisement, receive <br />bids therefor publicly. Such advertisement shall be published for at <br />least three days in a newspaper published in, or having a general cir- <br />culation in, the city of Portsmouth. Such bids may be upon such terms <br />and may be received in such .vranner as the City Manager m~y determine, <br />unless the council shall direct otherwise. <br /> <br /> (c) The city m~y sell or convey any of its property to the <br /> Commonwealth of Virginia, any political subdivisio~ thereof, or to the <br /> federal government and may do so without advertisement and without <br /> receiving bids. <br /> <br /> CHAPTER III. SECTION 31(A). In any action against the city to <br /> recover dsm~ges against it for any negligence, where any person is liable <br /> with the city for such negligence every such person shall be joined as <br /> defendant with the city in any action brought to recover dsmages for such <br /> negligence, and when there is a verdict and judgment against the city, <br /> as well as the other defendaut, it shall be ascertained by either the <br /> court or the jury which of the defendants is primarily liable for the <br /> damages assessed. <br /> <br /> CHAPTER IV. SECTI~ 46(A). The payment of any taxes to the <br /> city of Portsmouth, both those which nave been assessed and those which <br /> ought to have been assessed, may in addition co any remedies other~ise <br /> allowed 0y law, be enforced by warrant, motion, action of debt or <br /> assumpsit, bill in chancery, or by attachment in courts not of record <br /> and courts of record within this State in the same manner, to the san~ <br /> extent and with the same rights of appeal, as now exist or ~y hereafter <br /> be provided by law for the enforce~nv of demands between iudividuals. <br /> Such proceedings shall be instituted and conducted Ln the name <br /> of the city of Portsmouth at the request of the city council or the city <br /> treasurer. Any bill in chancery for the enforcement of a lien of taxes <br /> against land may be brought in the corporation or circuit court of the <br /> city and in such proceedings the property may be sold for the payment of <br /> the taxes due thereon, and such lien shall ~o any other lien <br /> or encumbrance upon t~e property or to dower or courtesy, <br /> and it shall not be necessary grotunds <br /> of J uris~iction, <br /> <br /> <br />
