corporations, of any land~ water, water rights or easen~nts, for the use <br />or purchase thereof, or ~ay have the s~me condemned for the location, <br />extension and enlargement of the s~id works, the pipes connected therewith~ <br />or any fixtures or app~u~tenances thereof. The city shall have power to <br />protect from injury by adequate penalties~ the said works, pipes~ fixtures <br />8nd l~nd~ or anytb~ connected therewith, ~tbx~n or without the limits of <br />the city, aud to prevent the pollution of the water, by prohibiting the <br />throwing of filth or offensive matter therein, or its pollution in any <br />other way, or in any other place where the water m~v be affected thereby; <br />and such prohibition may be enforced by proper penalties. <br /> 6~2~TER III. SE~fION 23(F). In addition to the other powers <br />conferred by law the city ~ay, in exercising the right of eminent dcmain~ <br />make use of the procedure prescribed by the general law or may elect to <br />proceed as herelnai~er provided. In the latter event the resolution direct- <br />lng acquisition of ~ny property shall provide therein for each parcel the <br />f~nds necessary to compensate the owners thereof for the property to be <br />acquired or dsmaged. Upon the adoption of such resolution the city may <br />file a petition for condemaation in the clerk's office of a court having <br />jurisdiction. <br /> <br /> Upon the filing of the petiticn aud the funds provided by the <br /> council for the purpose having been duly deposited to the credit of court, <br /> if the court is of the opinion that the property or interest or estate <br /> therein to be acquired is for the uses and purpose of the city as provided <br /> by law, it may order that the interest or estate of the o~er of such prOp- <br /> erty shall terminate ~nd the title to such property or the interest or <br /> estate to be taken in such property shall be vested a0solutely in the city <br /> and such owner shall have such interest or estate in the funds so deposited <br /> as he had in the proper~y taken or d~naged and all lier~ by deed of trusts <br /> judgment or otherwise upon said proper~y or estate shall be ~ransferred to <br /> such lkauds and the city shall have the right to enter upon and take pos- <br /> session of such property for its uses and purposes and to construct its <br /> works or i~prove~ents. ~ne clerk of the court in which such proceeding <br /> is instituted shall make and certify a copy of the order and deliver or <br /> transmit the sa~e to the clerk of the co~r~ in which deeds are a~itted to <br /> record, who shall record the ssme in his .deed book and index it in the <br /> of the ~ecord title owner of such property and in the name of the city. <br /> Ail other proceedings under this section shall be had in accordance <br /> with the provisions of the Virginia General Conderm~ation Act in so far as <br /> they are then applicable and not inconsistent with the provisions of this <br /> section. Provided, howevers that the provisions of Section 25-233 of the <br /> Code of Virginia, as now or hereafter in effect, shall apply to ~y prop- <br /> erty belonging to any corporation possessing the power of eminent domain <br /> that may be ~ further~ that nothing herein <br /> co~tained shall authority to acquire by eonde~na- <br /> tion <br /> <br /> <br />
