'WHEREAS, the Commonwealth of Virginia, Department of I~ighways, <br /> <br />and the City of Portsmouth propose to construct or otherwise improve a <br />part of Route 58 within the corporate limits of the City of Portsmouth <br />between High Street and Green Street and has prepared and submitted to <br />the Council plans for the statue, desi~ated as Route 58, State Froject~ <br />0058-124-102, Federal Project U-124-1 (6), which have been approved for <br />right of~way$ s_~ <br /> <br /> W~, it is the opinion of the Council that the said con- <br />s~ruction or other L~aprovemen~s will be of in~uediate and contLnuing <br />oenefit and advantage to the City of Portsmouth. <br /> <br /> NG~ ~tEREFORE, BE IT RESOLVe) that the City of Portsmouth, <br /> <br />through its Council, hereby agrees tb~t it will perform all'phases of the <br />right of way acquisition program in regards to relocation advisory assist- <br />ance in accordance with approved policies and procedures of the State <br />and Bureau of ~blic Roads~ Sufficient records of all transactions will <br />be kept for a period of not less ~nan three years ~er paymen~ of the <br />final voucher or that they be turned over to the Virginia Department of <br />Highways. Such records shall be made available ~o State and Bureau of <br />Public Roads Representatives. The City of Portsmouth understands that <br />where any pa~men~ or costs are made t~t do nod conform to policies and <br />~recedures thus becc~i~g ineligible for Federal participation, that the <br />State ~ilt no~ participate in this cos~. <br /> <br /> The City of Portsmouth further agrees ~o save the Cc~uonwealth of <br />Virginia, her officials ar~ .her employees, harmless frmm any and all claLms <br />for damages of whatsoever nature that may arise f~mu the owners, tenants~ <br /> <br /> <br />
