the Co~ucil of the <br /> Cz~y of Porbsm~th appoint an arbitrator for <br /> <br />the purpose of determio_ing the rates to be charged for water <br /> <br />furnished pursuant to said contract; and <br /> <br />the Co,uncil of the City of Portsmouth ~zlheres <br /> <br />to a~d desires to reaffirm its resolution of ~ch 12~ 1968 and <br /> <br />all actions taken therein; <br /> <br /> NOW, T~ORE, BE ~ ~OLVED by the <br />Council of the City of Portsmouth~ Virginia: <br /> <br /> 1. That said resolution adolfoed by the <br />Council of the City of Portsmouth on M~rch 12, 1968 and <br />ali actions taken therein shall be and are hereby in all <br />respects ratified~ approved and confirmed; and th~t~ <br />accordingly~ (i) all the provisions of the aforesaid con- <br />tract of ~rch 30, 1920, relating to arbitration h~ve <br />been revoked and annulled, (ii) the Council of the City <br />of Portsmouth reiterates and reaffirms its refusal to <br />submit to ~rbitration, or to appoint an arbitrator for <br />the purpose ofdetez~ining~ the r~tes to be charged for <br />water furnished pursuant to said contract~ (iii) said <br />contract in its entirety has been terminated and can- <br />celled, effective at 12 o'clock noon on ~rch 30, 197B, <br />and (iv) the Council of the City of Portsmouth is willing <br />to negotiate and enter into a new contract with the City <br />of Suffolk whereby the City of Portsmouth w~]] furnish <br />w~ter to the City of Suffolk and its inhabitants during a <br />reasonable period of ti~, not exceeding thirty years, <br />on such terms as the Cotu~cils of said Cities sh~11 deem <br />mutually fair and reasonable and shall approve by suitable <br />resolutions duly adopted by them. <br /> <br /> 2. That said contract of March 30~ 1920, or <br />~ny of the rights, interests or obligations thereunder, <br />could not be and has not been in any way ~ltered, <br />affected, impaired or enlarged by the amendment to <br />Section 8-503 of the Cede of Virginia Which became <br />effective on June 28, 1968. <br /> <br /> ~. That the City M~nager of the City of Ports- <br />mouth shall promptly notify the City of Suffolk of the <br />actions taken in this resolution by sending copies of <br />this resolution by United States registered m~il to the <br />M~yor and the City ¥~nager of the City of SuffolkJ <br /> <br /> <br />
