RESOLUTION REQUEST~]~;G ~ STATE HIGh[WAy COIv~fISSIONER _TO ACQULRE <br />T~HE RIG~ OF WAY FOR THE CRAWFORD S ~ <br /> - ~ CONNECTOR PROJECT. <br /> <br /> ~ERE~, Section 33-57 of the Code of Virginia, 1950, <br /> as amended~ authorizes the State Highway Com~ssior~r to acquire <br /> rights of way for the constr~ction, reconstruction, alteration, <br /> maintenance and rep~ of public highways within municipalities <br /> on projects which s_~e constructed with State or Federal partici- <br /> pation; and <br /> <br /> WHERK&S, the aforesaid statute further provides that the <br /> State Hig~hway Co.v~issioner may exercise such authority only upon <br /> receipt of official request from the city or to~ua involved. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that the Council of the <br />City of Portsmouth hereby requests the State Plighway Cmmmissioner <br />to acquire the necessary rights of way for Cra~ord Street Connect- <br />or Project U000-124-101 PE-101 R~V 201, C-50i within the Coroorave <br />Limits of said City and to convey the title, to such right of'~ay <br />to the City of Portsmouth upon completion of the project. ~ne City <br />of Portsmouth aga~ees to reimburse the State High~ay Department for <br />fifty percent (50,$) of all costs incurred in the acquisition and <br />conveyance of such rights of way and it is understood that such <br />acquisitior~ ~t! be hs~.dled by the Con~nissioner under established <br />policies and procedures and his decision in all ~-~ta~ces shall be <br />final. <br /> <br /> Adopted by the Cot~ncil of the City of Portsmouth, Virginia, <br />at a meeting held on ~zrCh 25, 1969. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
