Should any moneys~ other than capital items, derived from sources other than state funds be unexpend~d in any year and thus become available for use the next year pursuant to Section 22-138 of the Code of Virginia~ the council may provide in the budget that the city's share of the appropriation for the next ensuing year shall be decreased in a like amount. ARTICLE IX Administration of Justice 9.01. Municipal Court. There shall be a municipal court for the City o~f ~orts'mouth. Such court shall have both civil and criminal jur- isdiction and such other judicial powers as are conferred by general law on municipal courts of cities of the first class. ~ 9.02. ~Judge.s of the ~un~c~pal Court. The judge~ associate judges and substitute judges of the municipal court shall be appointed for four-year terms by the judge of the court of hustings for the City of Portsmouth. Appointments to vacancies shall be for the unexpired term. The terms of all associate judges and substitute judges shall be terminus with the verm of the Judge of said court. The term of the j~dge of the municipal court in office on the effect'ire date of this act shall expire on July l, 1970; his successor shall be appointed for a four-year term co~=mencing on July l, 1970. ~i1 appointments hereunder shall be subject to the approval of a majority of all the members of the city council. 9.03. Divisions of Court. The judge of the municipal court may designate divisions within the court to handle ca,es of a particular type or class; such divisions may be designated as police~ traffic or civil di- visions. In his sole discretion the judge of said ~ourt may ~assign the work of a particular division or divisions to him- self or such associate judges as may be appointed, in order to equalize the work load of such j~dges. § 9.0~. Juvenile and Domestic Relations Court. There shall be a juvenile and domestic 'relations court for the city. Such court shall possess the same jurisdiction and powers as are conferred by law upon juvenile and domestic relations courts of cities of the first class. 9.05. Judges of the Juvenile and Domestic'Relations Court. The judge, associate judges and substitute judges of the juvenile and domestic relations court shall be appointed for four- year terms by the Judge of the court of hustings for the City of Portsmouth.
