RESC~UTtON GRANTLNG A USE PEP~dll FOR THE OONSTRUCTION AND OPERATION OF A PUMPING STATION ON PROPERTY IN TP~ MERRIFI~tDS ~o~DMSION, UP-69-2; --~, Merrifields ~ater Company, Inc. has filed au application pur- .suaut to Section 4-2 of the Zoning Ordinance of bhe City of' Portsmouth, 1961, for the grauting of a use permit as hereinafter described; and WHEREAS, the app. li~ca~t, the Planning Director ar~ the City ~&anager have done ~] things requfrea to be done in connectionwith said application, aud the Plar~dng Conm~ssion has recommended the grant~ 9f said use permit, sub- Ject to the conditions hereinafter stated. NOW 'IF~FORE, BE IT RESOLVE~ by the Council of the City of Portsmouth, Virginia: That the use for which the use peru~it hereinafter described is sought (1) will not adversely affect the health or safety of rsons residing or working in the neighborhood of the proposed use, (2) ~11 not be detrimental t.o the public welfare or injur- ious to property or.improvements in the ~eighbo.rhood, a6d (3) will be in accord vr~th the purposes Of Said Zoning Ordinance. B. That Merrifields Water Company, Inc. is hereby granted a use permit, subject to site plan restrictions, pursuant to Section ~--2 of said Zoning Ordinance, for the construction and operation of a water pmmping station on property in the subdivision of Mer- / rifields and more particularly described as follows: Beginning at a point on the east right-of-way line of Forresthills Drive approximately 37a feet south of the southeast corner o£ Burrlaud Road and Forresthills Drive; thence northeast 125 feet to a rear lot line; thence southeast 90 feet to a point ;. thence southwest 125 feet to the east right-of-%~y line of Forresthills Drive; thence northwest along said right-of-way line 90 feet to the point of origin.
