A RESOLUfION GRA/ClS~G A USE F~4IT FOR THE EXPANSION ~ OPERA_7~ON 0F AN AUT0~iflvE ~VICE STATION AT THE CORNER OF HIGH STR~i' AND ELM AVENUE, UP 69-1. ~HE~EAS, Petroleum Service Company by James G. Luster has made application purs~ut to Section ~-2 of the Zoning Ordinauce of the City of Portsmouth, 1961, for the granting of a use pe~t as hereinafter described, aud WH~HEAS, the applicant, the Planning Df~ector and the City Manager have done ~1] things required to be done in connection with said application, and the Plar~ Co~amIssion has reomrmended the granting of said use permit, subject to the conditions hereinafter stated. NOW, ~EREFORE, BE IT RESOLVED by the Council of the City of Ports- mouth, Virginia: That the use for which the use permit hereinafter described is sought (1) will not adversely affect the health or safety of persons residing or work- ing in the neighborheod of the proposed use, _(2) w~]] not be detrimental to the public welfare or injurious to property or improvements in the neigh- borhood, and (3) will be in accord with the purpo~ ses of said Zoning Orddr~nce. That Petroleum Service Company is hereby granted a use permit, subject to site plan restrictions, pur- suant to Section 4-2 of said Zoning Ordinance, for the expansion and operation of an 8xisting automo- tive service station located on the property des- cribed as follo,~s: Beginning at the northeast corner of High Street and Elm Avenue; thence north 186 feet to a point; thence east 100 feet; thence south 73 feet; thence east 75 feet; thence south 113 feet to the north line of High Street; thence west 175 feet to the point of origin.
