A RESOLUTION GRANTING A USE PEP~IT FOR THE OPERATI~W OF AN Ab~OMOTIVE S~RVICE STATION ON THE SO~TH SIDE OF PORTSMOUTH BOUIEVARD ~ST OF ITS INTERSECTION WiTH TURNPIKE ROAD. WHEREAS, ~bbil Oil Corporation~has made an application pursuant to Section 4-2 of the Zoning Ordinance of the City of Portsmouth, 1961, for the granting of a use,permit as hereinafter described; and WHEREAS~ the applicant and the Planning Director have done all thing~ req~ir.ed to be done in connection with said application, and the ~ P. lanning Cmmmmssion has reco~r~mended the granting of said use Permit, sub~ Ject to the conditions hereinafter s~tated. ~ t NOW, THEREFORE, BE IT RESOLVED by the CoUncil of the City of Portsmouth, Virginia: . A. That the use for which the use permit hereinafter described n~s sought (1) will not ~versely affect the health Or safety of persons residing or working in th_.nei~borho0d~ of the p~oposed use, (2) will not'~ be detrLmental to the public W$1fare or injurious to property or improve-. ments in the neighborhood, and (3) will be in accord ~ith th~ Purposes of said Zoning Ordinance° B. That the 5~obil Oil Corporation is hereby granted a USe Der- mit: subje.ct to site plan restrictions, pUrSuant to Secti°n ~-2 of said~ Zor~ Ordinance, for the operationlof au'~automotive Service 'station lo- cated on the property described as ~follows: · - Be~Inning at a point on the southern right Of way tine of Portsmouth Boulevard ~ch said point is 350 · feet, more or less, West-of the eastern corner of the intersection of Portsmouth Boulevard and Turnpike Road; thence running South a distance' of 180 feet, more or less, to a point; thence running West a dis- tance of 200 feet, more or less, to a point; thence running North along ~he eastern right of way line of the proposed shopping center road along ~the arc of a curve to the right whose radiu~ is 322 feet a dis- tance of 1~6 feet, more or less, to a point; thence runnirg East along said southern right of way line of Portsmouth Boulevard a distance of 150 feet, more or less, to the point of beginning. C. Furthermore, this ~se permit is granted subject to a restriction limiting the maximum width of driveways for said site to 35 feet and with the Understanding that the median strip in the pre~osed shopping center read will not be cut to all~ access to this automotive service station site.
