A RESOLUTION REQUIRING THE REMOVAL OF CERTAIN ENCROACHIv~NTS FROM THE RIGHT OF WAY OF EFFZNGHAM STREET. WHEREAS, portions of buildings at 1620, 2504, 2508, 2520, and 2524 Effingham Street encroach on the right-of-way of the City of Portsm-outh~ Virginia, and by such encroachment hinder the widening and improvement of said Effingham Street; and _ ~EREAS, George, David and Fannie White, owners of 1620 EfFingnam Street, Leonard J. King, owner of 2504 Effing- ham Street, James and Medet!ia Mitchell, owners of 2508 Effing- ham Street, Dupont L. Davis, owner of 2520 Effingham Street, and Walter and Julia B. Fisher., owners of 2524 Effingham Street have all been notified to clear said right-of-way a minimum distance of four feet from the curb back of the widened Effing- ham,Street and all such owners have not cleared said right-of- way to such ~nimum distance. NOW~ THEREFORE~ BE IT RESOLVED b~ the Council oF the City of Portsmouth, ~irginia, that ~ursuant to Section 15.1-893 'of the Code of Virginia~ 1950, as amended, the aforesaid owners of the aforesaid properties are hereby required to remove each such encroachment to a distance of four feet from the presently existing or proposed cmrb back of the widened Effi~gham Street, on or before April ~ 1970. BE IT FURTHER P~SOLVED~ that if ths aforesaid encroach- ments remain after April 3, 1970~ the responsible owner shall be fined five dollars for emch and every day such encroachment remains-after Apri~ 3~ 1970, and the City Engineer shall cause such encroachment to be removed, the cost of such remcval to be ch~ged against the subject property as a tax thereon. A copy of this resolution shall be mailed to the aforesaid owners. Adopted by the Council of the City ~f Po~rtsmouth~ Vir- ginia, at a meeting held March 24~ 1970.
