41 A RESOLUTION G~ANTING A USE PERi, IT FOR THE OPERATION OF ~.~ AUTOM~ ~ ~uTIVm SERVICE STATION AT THE SOUTi{EAST INTERSECTION OF LONDON AND EFFINGit~! STREETS. ~%~REAS, Imperial Developers, Inc., has made application pursuant to Section 4-2 of the Zoning Ordinance of the City .of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said ap- plication, and the Planning Commission has considered the grant- ing of said use permit, subject to the conditions hereinafter stated. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmoumh, Virginia: A. That the use for which the use permit hereinafter described is sought (1) will not adversely affect the health or safety of persons residing or working mn the neighborhood of the proposed use, (2) will not be detrimental to the public welfare or injurious to property or improvements in the nemghborhood, and (3) will be in accord with the purposes of said Zoning Ordinance. B. That Imperial Developers, Inc., is hereby granted a use permit subject to site plan restrictions, pursuant to Section 4-2 of said Zoning Ordinance for the operation of an Automotive Service Station located on the property described as follows: Beginning at the southeast corner of London and Effing- ]lam Streets~ thence east along London Street approximately 184 feet; thence south approximately 115 feet to a point; thence west approximately 60 feet to a point; thence south approximately 57 f~et to a point; thence west approximately 120 feet to Effingham Street; thence north along Effingham Street approximately 175 feet to London Street, the point of beginning.
