in the undertaking and carrying out of any program or activity <br />receiving federal funds under Title I of the Housing Act of <br />1949, as amended; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE <br /> CITY OF PORTSMOUTH, VIRGINIA: <br /> <br /> 1o That the City Manager be and is hereby directed, for and <br /> on behalf of the City of Portsmouth, to file an application <br /> with the Department of Housing and Urban Development for funds <br /> to defray a portion of the cost of instituting a concentrated <br /> program enforcing the provisions of the City Code and for the <br /> construction of certain public improvements in the Mount Hermon <br /> and Park View areas of the City of Portsmouth as set forth in <br /> Section 117 of the Housing Act of 1949, as amended; said funds <br /> shall represent two-thirds of the cost of the program, which <br /> cost is estimated to be $2,~48,969.73. <br /> <br />2. That the City Manager is further authorized and directed <br />to provide such information and furnish such documents as may <br />be required by the Department of Housing and Urban Development, <br />to execute such contract or contracts as may be necessary for <br />the grant applied for, and to otherwise act as the authorized <br />representative of the City of Portsmouth in accomplishing the <br />said program. <br /> <br />3. That during the period of the grant for code enforcement, <br />the City will maintain a level of expenditures for code en- <br />forcement activities exclusive of expenditures in any federally <br />assisted code enforcement or Title I urban renewal project <br />areas that is not less than the average yearly expenditure for <br />such activities throughout the City for the two full fiscal <br />years immediately preceding the filing of such application. <br /> <br />4. That the City will maintain a program for and will provide <br />in a timely manner all necessary public improvements for the <br />code enforcement areas. <br /> <br />5. That the Council is of the op~n~on that there exists in the <br />City an adequate amount of decent, safe and sanitary housing <br />which is available to persons displaced as a result of the con- <br />centrated code enforcement and public improvements programs at <br />prices which are within their financial means and which are not <br />generally less desirable in regard to public utilities and public <br />and commercial facilities than the dwellings of persons that may <br />be displaced; and it is the sense of the Council that such dis- <br />placed persons, if any, will be relocated in accordance with <br />applicable regulations of the Department of housing and Urban <br />Development. <br /> <br /> <br />
