A RESOLUTION TO AUTHORIZE AND DIRECT THE CITY MANAGER, F6R <br />AND ON BEHALF OF THE CITY OF PORTSMOUTH, TO FILE AN APPLI- <br />CATION WITH THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT <br />FOR FUNDS TO DEFRAY A PORTION OF THE COST OF INSTITUTING A <br />CONCENTRATED PROGRAM ENFORCING THE PROVISIONS OF THE CITY <br />CODE, AND FOR THE CONSTRUCTION OF CERTAIN IMPROVEMENTS IN <br />THE MOUNT HERMON AND PARK VIEW AREAS OF THE CITY OF PORTS- <br />MOUTH. <br /> <br /> WHEREAS, Section 117 of the Housing Act of 1949, <br />as amended, authorized the Secretary of the Department of <br />Housing and Urban Development to make grants to municipali- <br />ties to assist them in conducting concentrated programs <br />enforcing certain provisions of local codes and for the <br />construction of certain public improvements in deteriorated <br />or deteriorating areas in which such enforcement, together <br />with such public improvements to be provided by the City, <br />may be expected to arrest the deterioration of such areas; <br />and <br /> <br /> WHEREAS, it has been represented to the Council, <br />and the Council finds that there exists in the Mount Hermon <br />and Park View areas.of ~e City of Portsmouth certain de- <br />teriorated or deteriorating areas for which such a program <br />may be expected to arrest the deterioration of these areas; <br />and <br /> <br /> WHEREAS, Section 117 of the Housing Act of 1949 as <br />amended, imposes certain obligations upon the City of Ports- <br />mouth to assure that any persons who may be displaced as a <br />result of the concentrated code enforcement and public im- <br />provements programs are provided decent, safe and sanitary <br />housing; and <br /> <br /> WHEREAS, the Portsmouth Redevelopment and Housing <br />Authority has assured the Council of the City of Portsmouth <br />tha~ any persons who may be displaced as a result of the con- <br />centrated code enforcement and public improvements programs <br />will be relocated into decent, safe and sanitary housing in <br />accordance with the regulations of the Department of Housing <br />and Urban Development; and <br /> <br /> WHEREAS, Title VI of the Civil Rights Act of 1964 <br />and the regulations of the Department of Housing and Urban <br />Development provide that no person shall, on the grounds of <br />race, color or national origin be excluded from participating <br />in, be denied the benefits of or be subjected to discrimination <br /> <br /> <br />
