A RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA TO AMEND <br />THE 'CHARTER OF THE CITY OF POKTS~4OUTH, VIRGINIA. <br /> <br /> WHEREAS, Sections 15.1-835 and 15.1-912 of the Code of <br />~;irgirria~50~-as-am~n--c~d,-provide for~ the amendment of the City <br /> Charter upon the holding of a public hearing and the request of <br /> the City Council to the General Assembly; and <br /> <br /> WHEREAS, the City Council is of the opinion that certain <br />amendments to the Charter of t~he City of Portsmouth are necessary <br />and desirable at this time and has held the public hearing required <br />by law to consider such amendments. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Attorney is hereby directed <br />to prepare and transmit to the General Assembly, together with certi- <br />fied copies of this resolution, drafts of bills amendingthe Charter <br />of the City of Portsmouth, 1970, as follows: <br /> <br /> 1. By repealing sections 9.02, 9.03, 9.04, 9.05, 9.06, <br />9.07 and 9.08. <br /> <br /> 2. By adding section 2.14 thereto and by amending sections <br />2.06, 2.12, 3.02, 3.03, 3.04, 3.11, 5.02, 6.02, 6.05, 6.07, 8.02, <br />9.01, 10.08, and 10.109 thereof, such new and amended sections to <br />read as follows: <br /> <br />Section 2.06. Eminent Domain - Generally. <br /> <br /> (a) The powers of eminent domain set'forth in Title 15.1, <br />Chapter 1.1 of Title 25, and Chapter t of Title ~ 33.1, Code of <br />Virginia, 1950, as amended, and all acts amendatory thereof and <br />supplemental thereto, mutatis mutandis, are hereby conferred upon <br />the city of Portsmouth. <br /> <br /> (b) In any case in which a petition for condemnation is <br />filed by or on behalf of the city, a true.copy of the Ordinance or <br />resolution duly adopted by the council, declaring the necessity for <br />any taking or damaging of any property within or without the city, <br />for the purposes of the city, shall be filed with the petition-and <br />shall constitute sufficient evidence of the necessity of the exer- <br />cise of the powers of eminent domain by the city. <br /> <br />Section 2.12. Real Estate Assessments. <br /> <br /> (a) Ail real estate within the city of Portsmouth shall <br />l- be assessed for taxation in accordance with the provisions of the <br /> <br /> <br />
