Du~=, Admln~s.~rator, has W~EREAS, Mrs. Phi!grador D ~ ~ ~ ,' ms~ ~ ]~-t~on ~ursuan~ to Secm~on ~-z of the Zo~mng of the City o~ Poztsmou~n~ 19~'2~ for the ~ ~ mit as hereinafter descr, ibed; and W~EREAS, the applicant and the Planning Director have accomplished all transactions required to be completed in con- nection with said application; and WHEREAS, the Planning Commission has considered the application for such use permit and recommended favorable dis- position. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: A. That the Council expressly finds that the use for which the use permit herein described is sought (1) will not ad- versely affect the health or safety of persons residing or work- ing in the neighborhood of the proposed use, (2) that it will not be detrimental to the public welfare, and (3) that it will be in accord with the purposes of said Zoning Ordinance. B. That ~s. Philgrador D. Duke is hereby granted a use permit pursuant to Section 4-2 of said Zoning Ordinance for the operation of a day care center located on the property des- cribed as follows: Beginning on the west side of Bagley Street approximately 60 feet south of its intersection with Killian Avenue; thence southerly along Bag- tey Street approximately 75 feet to a side pro- perty line; thence westerly approximately 160 feet to a rear property line; thence northwest · approximately 20 feet; thence north approximate- ly 45 feet; thence easterly approximately 147 feet to Bagley Street, the point of origin.
