A RESOLUTION REAFF!P~IING AND READOPTING PROPOSED CHANGES TO TEE CF~RTER OF THE CITY OF PORTSMOUTH, 1970 AS REQUIRED BY CHAPTER r35i OF THE ACTS OF TF~ GENE~RAL ASSF2~BLY OF VtRGiNIA~ 1973. WHHREAS~ by resolution duly adopted on December !972~ ~he council of the city of Portsmouth~ Virginia~ did forward to the General Assembly of Virginia£ proposed changes in the Charter of the City of Portsmouth~ Virginia~ !970~ pursuant to and in accordance with Sectioms 15.1-835 a~d 15ol-912 of the Code of Virginia~ 1950~ as amended; and ?UzLEP~AS~ such proposed changes to sections 3o02~ 3°03, 3oO5~ 3.06 and 3.08 of the Charter of the City of Portsmouth~ 1970~ contained~ among other things, pro- visions f~r the election of the mayor from the city at !arge~ and ~E~REAS~ although the General Assembly of Virginia passed such proposed ckanges~ they saw fit to append thereto the following requirer~ent which is reflected in clause 2 of chapter 351 of the Acts of Assemb!y~ 1973: ~The provisions of sections 3.0t~ 3.02, 3.05~ 3.06 and 3.08 of the charter of the city of Portsmouth, as amended, in clause 1 of this act shall not be effective until an affirmative vote of a majority of the city council subsequent to the passage of this act and a referendum shall have been conducted in the city of ~orts- mouth to ascertain the sense of the qualified voters thereof .... NOW~ THEREFORE~ BE IT RESOLVED by the Council of the City of Portsmouth, Virglnia, that it does hereby readopt and reaffirm the.proposed revisions of sections 3.01~ 3.02, 3oO3~ 3.05, 3~06 and 3~OS of the Charter of the City of Portsmouth? 1970~ as amended~ such proposed revisions containing provisions for the popular election of the mayor from the city at large and being as set forth i~ the copy of the resolution originally adopted by this council on December I9, t972~ attached hereto.
