A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY T~ CITY OF PORTSMOUTH, VIRGINIA, UN~ER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY OF 1970, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR THE WIDENING OF AIRLINE AND VIC- TORY BOULEVARDS. ~{EREAS, the City of Portsmouth has found it necessary to acquire the interest hereinafter specified in and to the here- inafter described parcel of land situate in the City of Portsmouth, Virginma, for the purpose o~ widening Airline and Victory Boulevards; and WHEREAS~ the City of Portsmouth has not been able to purchase the property described herein, necessary to the project, because the owners thereof and the City have not been able to agree upon the price to be paid therefor, or the City has not been able to locate certain of the owners or because of the status of the title of the property; and ?~EREAS, advancement of the work and use of said project will be delayed unreasonably if the said property is not made avail- able as soon as possible. NOW~ THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginza: 1. The City Attorney is directed to institute eminent domain proceedings, ~ptoying special counsel for that purpose if he deems it advisable, against the following property situate in the City of Portsmouth, zor the purpose of acquiring fee simple title therein, ~oge~ner with any and all easements of access, light or air incident to the lands of the lando~mer abutting upon said property, in accordance with and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of 1970, as amended), and to deposit to the credit of the court as provided bv law the s~ hereafter specified to compansate the owners of the parcel of land, as shown on that certain plat entitled, "Plat Showing Proposed Right Of Way Acquis- ition For improvements To Intersection Of Airline Boulevard and Victory Boulevard From Stanley H. & Barbara J. Jordan, Esther Goodman", dated September 28, 1973, a copy of which is filed with the Department of Engineering of the City o~ Portsmouth, Virginia. Name Amount Stanley H. Jordon, Barbara J.
