5 A RESOLUTION GRANTING A USE PEtA%IIT FOR THE OPERATION OF A DAY C~RE -CENTER AT T~EE NORTHWEST CORNER' OF PORTSM~U-TH ~B~ULEVARD ~AN~ CHESTNUT STREET (UP-74-2) . WHEREAS, Miller Home & Day Nursery has made application pursuant to Section 40-67 of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicann and the Planning Director have accomplished all transactions required to be completed in con- nection with said application; and WHEREAS, the Planning Commission has considered the application ~for such use p~rmit and recommended favorable dis- position. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: A. That the Council expressly finds that the use for which the use permit herein described is sought (t) will not ad- versely affect the health or Safety of persons residing or work- lng in the neighborhood of the proposed use, (2) that it will not be detrimental to the public welfare, and (3) that it will be in accord with the purposes of said Zoning Ordinance. B. That Miller Home & Day Nursery is h~reby granted a use permit pursuant to Section 40-67 of said City Code for the operation of a day care center located on the property described as follows: Beginning at the northwest corner of Ports- mouth Boulevard and Chestnut Street; thence north along the west right of way tine of Chestnut Street approximately 155 feet; thence west along a side property line approxin~tely 150 feet; thence south along a side property line approxi- mately 135 feet to the north right of way line of PortsrmDuthBoulevard; thence east along said right of way approximately 155 feet %o Chestnut Street, the point of origin.
