33 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY OF <br />THE CITY OF PORTSMOUTH~ VIRGINIA ULCER TS~ EMINENT DO~tN PROCEED- <br />INGS PURSUANT TO C~APTEH 471 OF THE ACTS OF ASS~[BLY OF 1970, AS <br />~2~[ENDED, SAID PROPERTY BEING NECESSARY FOK THE ~DENiNG OF AIRLINE <br />BOULEVARD NEAR ITS INTERSECTION WITH VICTORY BOULEVARD~ <br /> <br /> WHER~AS, the City of Portsmouth has found it necessary <br />to acquire the interesm hereinafter specified in and to the here- <br />inafter described parcel of land situate in the City of Portsmouth, <br />Virginia, for the purpose of widening Victory Boulevard; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to <br />purchase the property described herein, necessary to the project, <br />because the owners thereof and the City have not been able to <br />agree upon the price to be paid therefor, or the City has not <br />been able to locate certain of the o~ers or because of the status <br />of the title of the property; and <br /> <br /> ~qERE~AS, <br />ject will be delayed <br />available as soon as <br /> <br />a~vanc~enm of the work and use of said pro- <br />unreasonably if the said property is not made <br />possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth ¥-rgznma: <br /> <br /> 1. The City Attorney is directed to institute emiD~nt <br />domain proceedings, employing special counsel for that Purpose if <br />he deems it advisable, against the following property situate in <br />the City of Portsmouth, for the purpose of acquiring fee simple <br />title therein, together with any and all easements of access: <br />light or air incident to the lands of the !ando~vner abutting upon <br />said property, in accordance with and pursuant to Sec%ions 2.06, <br />2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter <br />471 of the Acts of Assembly of 1970~ as amended),.and to deposit <br />to the credit of the court as provided by law the sum hereafter <br />specified to compensate the owners of the parcel of land~ as show~ <br /> · ~ Blt_ups Eastern Petro!e~3~m Company," <br />on tna~ certain plat entitled, " ' t, <br />dated May 21, 1973, a copy of which i~ filed with the Department <br />of Engmneering of the City of Portsmouth, Virginia. <br /> <br />Amerada Hess Corporation <br /> <br />$17,361.00 <br /> <br /> Adopted by ~h~ Co=ncm~ of the City of Portsmouth~ Vir- <br />ginma~ at a meeting held April 23, t974~ <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
