A RESOLUTION CO?~'!tTT!NG THE CITY OF ..... ~-~n TO SEEK TI~'~LY RELOCk?iON OF CERTAIN UTILITY FACILiTiLS SO AS TO EXPEDITE CO~S~RUClIOi~ OF A_ PORTION OF THE W,-ESTERi~ WHEREAS, the State Highway Department proposes to con- struct the Western Freeway from 0.419 miles east of the western branch of the Elizabeth River to 0.104 miles east of the Norfolk, Franklin & Danville Railway designated as Highway Project 0164- 124-101, C-501; and ~REAS, this Council is responsible for making arrange- ments for the adjustment and/or relocation of certain utilities and for the installation of any new facilities; and WHEREAS, the said utilities are identified as follows: Utility Dwner Type of Facility Portsmouth Gas Company Virginia Electric and Power Co. The Chesapeake and Potomac Telephone Company of Virginia City of Portsmouth Gas Electric Communications Water & Sanitary Sewer NOW, THEREFORE, BE IT RESOL%~D, by the Council of the City of Portsmouth, Virginia, that this Council hereby certifies that all arrangements have been made or will be made for the re- location and/or adjustment of said utility facilities, and for the installation of any new facilities. In the event of any ~s%ifi~ble claims from the road-~n~tractor for delays or inter- ference caused by said utilities, the City of Portsmouth hereby agrees to be responsible for said claims, provided it may legally do so and further provided that the City is advised in writing by the State Highway Department at the time of delay that the road contractor intends to file a claim ~'~ · ~n_ obligations and re- sponsibilities assumed by the City of Portsmouth in this resolution shall be valid and binding between the City and the State Highway Department, but shall not inure to the benefit of any other person or corporation.
