80a A RESOLUTION REQUESTING TEE VIRGINIA MUNICIPAL LEAGUE TO SEEK ACTION OF THE VIRGINIA GENERAL ASSEMBLY TO CLARIFY AND DEFINE THE POWERS, RIGHTS~ DUTIES AND RESPONSIBILITIES OF VIRGINIA LOCALITIES IN THE AREA OF PUBLIC EMPLOYEE LABOR RELATIONS. WHEREAS~ public employees in the Commonwealth of Virginia have sought to foster their economzc interests by organizing into unions, associations and other collective bargaining units; and WHEREAS, such organization activities have included the City of Portsmouth; and WHEREAS, this Council has received an opinion from the office of the Cit~ Attorney that it lacks express authority to recognize any union or to enter into a binding collective bargaining agreement with a union; and WHEREAS~ the Attorney General of Virginia has like- wise published an official opinion stating that Virginia localities lack express authority to recognize unions or to enter collective bargaining agreements; and ~'~EREAS, there exists a state of public confusion as to the legal status of unions as collective bargaining agents for public employees in Virginia. NOWr THEREFOREr BE IT RESOLVEDt by the Council of the City of Portsmouth, Virginia: 1. That the Virgznma Municipal League be~ and it hereby zs~ urgently petitioned to seek action from the Virginia General Assembly to clarify and define the powers, rights~ duties and responsibilities of Virginia localities in the area of public employee labor reiations. 2. That the City Clerk be, and he hereby is, author- ized and directed to forward certified copies of this resolution to the Virginia Municipal League and all members of Virginia General Assembly from the City of Portsm. outh.
