26 A RESOLUTION TO PROVIDE FOR Thq~ ACQUISITION .OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER ~INENT DOMAIN PRO- CEEDINGS PURSUANT TO Ct{APTER 471 OF TP.~ ACTS OF ASSEMBLY OF 1970, SAID PROPERTY BEING NECESSARY FOR Tk~ CONSTRUCTION OF A FIRE STATION BOULnDED ON THE WEST BY LEE AVENUE, O~ THE F~.ST BY INDUSTRIAL.AVENUE A~D ON THE SOUTH BY CLEVELA~qD STREET IN THE CITY OF PORTSMOUTH. WHEREAS, theCity of Portsmouth has found it neces- sary.to acquire the interest hereinafter specified in and to the hereinafter described parcel of land situate in the City of Portsmouth, Virginia, for the purpose of constructing a Fire Station; and W]KEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to the project, because the o%~ners thereof and the City have not been able to agree upon the price to be paid therefor, or the City has not been able to locate certain of the owners er because of the status of the title of the property; and ~4_EREAS, advancement of the work and use of said project will be delayed unreasonably if the said property is not made available as soon as possible. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. The City Attorney is directed to institute emi- nent domain proceedings, employing special counsel for that purpose if he deems it advisable, against the following property situate in the City of Portsmouth, for the purpose of acquiring fee simple title therein, together with any and all easements of access, light or amr incident to the lands of the landowner abutting upon said property, in accordance with and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Ports- mouth (Chapter 471 of the Acts of Assembly of 1970), and to de- posit to the credit of the courn as provided by law the sum here- after specified to compensate Naomi Johnson and Willie Johnson~ or if any of the above named defendants be not living, then their heirs or devisees toget~erwith any and all other persons, known or unknown, who may hav~ an interest, right, title or claim in and to the property sought to be condemned, who are the owners or who havean interest therein of the hereinafter described pro- perty.
