16 A RESOLUTION DIRECTING THE CITYMANAGER TO ESTABLISH BY JULY l, 1975 A MEET AND DISCUSS PROCEDURE WITH ~4PLOYEES PERTAINING TO WAGES, HOURS AND CONDITIONS OF EMPLOYMENT; DIRECTING THE CITY MANAGER TO REPORT TO COUNCIL EACH YEAR THE SUBSTANCE OF SUCH DISCUSSIONS; COmmITTING THE COUNCIL TO CONSIDER THE SUBSTANCE OF SUCH DISCUSSIONS IN WEIGHING THE PUBLIC INTEREST DURING A~UAL BUDGET DELIBERATIONS. WHEREAS, the Attorney General of the Commonwealth of Virginia ruled on October 7, 1974 that "local units of govern- ment may not enter into collective bargaining agreements absent express statutory authority from the General Assembly"; and WHEREAS, this Council did on October 8, 1974 request the~General Assembly of the Commonwealth of Virginia to clarify and define the powers, rights, duties and responsibilities of Virginia localities in the area of public employee labor re- lations; and WHEREAS, the General Assembly of the Commonwealth of Virginia refused to take such action; and WHEREAS, there continues to be no direct or implied power authorizing municipal corporations of Virginia to re- cognize employee labor organizations and/or to enter into the procedures of collective bargaining; and WHEREAS, this Council recognizes that the trusted publi~ servants of the City of Portsmouth seek and deserve the right to discuss their conditions of employment with manage- ment; and WHF~REAS, this Council has heretofore established a procedure for the hearing of individual grievances. BE IT RESOLVED by the Council of the City of Ports- mouth, Virginia: 1. That the ~ity Manager is directed to establish by July 1, 1975 a procedure whereby person~ delegated by the City Manager shall each year meet and discus° wages, hours and con- ditions of employment with employees prior to submitting his budget recommendation to City Council. 2. That the City Manager is directed to report to the City Council the substance of such discussions in the form of a report prior to submission of his annual budget recommend- ation.
