date for the filing of petitions and notices of acceptance <br />as specified herein~ such resignation to be effective tt/e <br />thirtieth day of June of such election year. Such resignation <br />shall state the councilman's intention to run for the office <br />of mayor and shall requlre no formal acceptance by the remaining <br />members of council and shall be final and irrevocable as of <br />the date it is tendered. <br /> <br /> (2) The remaining two year term of office of any <br />councilman who has resigned for the stated purpose of running <br />for the office of mayor shall be filled at the same suceeding <br />general municipal election in which the office of may is <br />elected. After such resignation such two year term shall be <br />filled by the candidate for councilman receiving the next <br />highest vote to those candidates declared elected to the office <br />of councilman pursuant to subsection (b) of this section. <br />Such two year term shall begin on the first day of July next <br />following the date of such election. <br /> <br /> (c) The city clerk shall notify all successful can- <br />didates of what is necessary for them to do to qualify for <br />office immediately after their election has been certified by <br />the proper officials° <br /> <br />Section 3.04. Vacancies in office of councilman° <br /> <br /> Vacancies in the office of councilmen, except for re- <br />signations to run for the office of mayor, shall be f'illed <br />for the unexpired portion of the term by majority vote of <br />the remaining members of the council, or, if thC council shall <br />fail to fill a vacancy in its membership within~sixty days <br />of the occurrence of the vacancy, by appointment by a majority <br />of the judges of the Circuit Court of the city. If any person <br />elected to the council at a regular municipal election shall <br />fail to take the oath of office prior to the first day of <br />July following such election~ he shall be deemed to have de- <br />clined the office, and his seat shall be deemed vacant. If <br />any person appointed to the council to fill an unexpired term <br />shall fail to take the oath of office within thirty days <br />of such appoin~ent, he shall be deemed to have declined the <br />office, and his seat shall be deemed vacant. <br /> <br /> 2.
