llO <br /> <br />A RESOLUTION ASSURING T~LAT THE CITY WILL DEVELOP ~JD <br />TAIN AN INDUSTRIAL COST RECOVERY SYSTEM WHICH SHALL REQUIRE <br />ALL INDUSTRIAL USERS TO PAY THAT PORTION OF THE GRANT <br />ALLOCABLE TO THE TREATMENT OF WASTES FROM SUCH USERS: ASSURING <br />THE CITY WILL REVISE ITS USER CHARGE SYSTEM IF DISD~PROVED BY <br />THE ENVtRONMENTD~ PROTECTION AGENCY. <br /> <br /> WHEREAS, the City has applied for a grant to up- <br />grade the sewage treatment plant; and <br /> <br /> ~H~EREAS, to receive such grant, certain assurances <br />must be made to the Environmental Protection Agency. <br /> <br /> NOW, THEREFORE, BE IT RESCLVED by the Council of <br />the City of Portsmouth, Virginia, that the City of Portsmouth, <br />Virginia will develop and maintain an industrial cost recovery <br />system which shall require all present and future industrial <br />users to pay that portion of the grant amount allocable to <br />the treatment of wastes from such users in conformance with <br />40 CFR 35.92B. <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City <br /> of Portsmouth, Virginia, that should Envzronmentat Protection <br /> Agency disapprove the system for not conforming with 40 CFR <br /> 35.935-13, the City of Portsmouth, Virginia, will revise the <br /> system to conform with 40 CFR 35.935-13 according to the follow- <br /> zng schedule and that said system will be maintained: <br /> (t) User charge system to be redrafted and sub- <br /> mitted to Environmental Protection Agency for preliminary re- <br /> view and com~.ent within Three Hundred (300) days after accept- <br /> ance of the grant offer. <br /> <br /> (2) Submission of revised user charge system to <br /> appropriate governmental entity(ies) for adoption within <br /> Sixty (60) days of recempt of Environmental Protection Agency,s <br /> comment on draft. <br /> <br /> City Council, Name(s) of entity(ies)- <br /> <br /> (3) Adoption of revised user charge system by <br /> appropriate governmental entity(ies) within Thirty (30) days <br /> after submissmon for adoption. <br /> <br /> (4) Submission of adopted revised user charge <br /> system to Environmental Agency for review and approval withmn <br /> Thirty (30) days after adoption of system. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br /> held October 28, 1975. <br /> <br />Virginia, at a meeting <br /> <br />Teste: <br /> <br />City clerk <br /> <br /> <br />
