That the use for which the use permit hereinafter <br /> described is sought (1) will not adversely affect the health or <br /> '=' ng mn the nezghoorhood o <br /> ~ = persons resm~mng or work~ <br /> safe~y oz <br /> the propcsed use, (2) w~ll not be ~etrimental to the public <br /> welfare or injurious to property or improvements in the neighbor- <br /> hood, and (3) will be mn accord with the purposes of the zoning <br /> Chapter of the City Code. <br /> b. ~he City of Portsmouth is hereby granting a <br /> conditional us~ permit pursuant to Section 40-75(b) of the <br /> City Code to o~erate a Day Nursery upon conditions hereinafter <br /> set out on ~he'property described as follows: <br /> BEGINNING on the east side of Deep Creek <br /> Boul ~vard 267 feet, more or less, from its inter- <br /> section with Shiloh Place; thence easterly 153 <br /> feet more or less to a point; thence south 44 <br /> fee%, more or less to the williams Court property <br /> line; thence easterly along said line 60 feet <br /> to e point; thence north 73.77 feet to a point; the <br /> ~n~rce westerly 182 feet, more or less to <br /> eas~ right-of-way line of Deep Creek Boulevard; <br /> the!ce southerly along said right-of-way 60 feet; <br /> more or less to the POINT OF BEGINNING. <br /> c.
