103 ~ --~ ~ TO PROVIEE FOR THE ACQUISITION OF CERTAIN PROPERTY A RmSO~U-,!ON ~N~ E?,IINENT DONAIN PRO- BY THE CITY OP PORTSMOUTH~ VIRGINIA, TT~n~-- '~ CEEDtNGS PURSUANT TO CHAPTER 471 OF THE ~_CTS OF ASSEMBLY, AS - N.~ ES SARY AHENDED~ SAiD PROPERTY BEING ~P~ P0R THE CONSTRUCTION~ ALTERATION AND WIDENING OF WOOL AVENUE. WHEREAS~ the City of porvsmouth has found it necessary t~ acquire the interesv hereinafter specified in and to the hereinafteF des3ribed earcel of land sivuate in the City of Portsmouth, Virginia~ for the purpose of constructing~ altering wmd~n~ng Wool Avenue. and ' ~ NHER~AS, the City of Portsmou~- has not been able to purchase the property described herein, necessary to the pro- ject~ because of a defect in the ~zvt to the property in that the~present record owners cannov be located; and WHEREAS, advancemenv of the work and use of said pro- jecz will be delayed unreasonably if said property is not made available as soon as possible. ~ E BE IT RESOLVED by the Council of the NOW, THEREFOR., City of Portsmouth, Virginia: 1. The City Attorney is direcsed vo institute eminent domain proceedings against the following ~ropervy situate in the City of Portsmouth, for the purpose of ac%uiring fee simple title therein, sogether with any and all easements of access, light or air incidenv vo the lands of zhe landowner abutting upon said property, in accordance and pursuan~ to Sections 2~.06~ 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapver 471 of the Acts of Assembly of 1970~ as amended), and to deposit to the credit of the Clerk of the Circuit Courv of the City of ~ortsmouth as provided by law the sum hereinafter specified to compensave the owners of the parcel of land~ kno~m, numbered, and~ d lesignated as Parcel 22 as shown on tha~ certain plat entmt~e. "Property To Be Conveyed To City Of portsmouth For Mt. Herman P~ooect VAR-69'~ dated July 25 Conservation And Developmenv ~ ' ~ ' 1975, made by Baldwin & Gregg~ Ltd.: reference to said plat being male for a more earticular description of the property. A copy of said plat is attached here¥o. Name of the propersy owner Essie F. Overvon, et al~ heirs of Daniel E. Overvon to be paid $24.00.
