86 <br /> <br />A RESCLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />BY THE CITY OF PORTSblOUTH, VIRGINIA, UNDER EMINENT DOMAIN PRO- <br />CEEDINGS PURSUANT TO CttAPTER 471 OF THE ACTS OF ASSEMBLY, AS <br />AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, <br />ALTERATION AND WIDENING OF WOOL AVENUE. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary <br />to acquire the interest hereinafter _~peeified in and to the <br />hereinafter described parcel of land situate in the City of <br />Portsmouth, Virginia, for the purpose of constructing, altering <br />and widening Wool Avenue. <br /> <br /> ~VHEREAS, the City of Portsmouth has not been able to <br />purchase the property described herein, necessary to the pro- <br />ject, because of a defect in the title to the property in that <br />the present record owners cannot be located. <br /> <br /> WHEREAS, advancement of the work and use of said pro- <br />jecl will be delayed unreasonably if said property is non made <br />available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia; <br /> <br /> 1. The City Attorney is directed to institute eminent <br />domain proceedings against the following property situate in the <br />City of Portsmouth, for the purpose of acquiring fee simple title <br />therein, together with any and alt easements of access, light or <br />air incident to the lands of the landowner abutting upon said <br />property, in accordance and pursuant to Sections 2.06, 2.07 and <br />2.08 of the Charter of the City of Portsmouth (Chapter ~71 of <br />the Acts of Assembly of 1970, as amended), and to deposit to <br />the credit of the Clerk of the Circuit Court of the City of <br />Portsmouth as provided by law the sum hereinafter specified to <br />compensate the owners of the parcel of land known, numbered and <br />designated as Parcel 7 as shown on that certain plat entitled <br />"Property To Be Conv~yed To City Of Portsmouth For Mt. Herman <br />Conservation And Development Project VAR-69," dated July 2S, <br />1975, made by Baldwin & Gregg, LTD., reference to said plat <br />being made for a more particular description of the property. <br />A copy of said plat is attached hereto. <br /> <br /> Name of the property owner William M. Drew and amount <br />to be paid S22.00. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held August 19, 197S. <br /> <br />City Clerk <br /> <br /> <br />
