85 <br /> <br />A RESOLUTION TO PROVIDE FOR TIlE ACQUISITION OF CERTAIN PROPERTY <br />BY THE CITY OF PORTSg{OUTH, VIRGINIA, UNDER E}IINENT DOMAIN PRO- <br />CEEDINGS PURSUANT TO CtIAPTER 471 OF THE ACTS OF ASSEblBLY, AS <br />AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION <br />ALTERATION AND WIDENING OF WOOL AVENUE. <br /> <br /> WHnREAS, the City of Portsmouth has found it necessary <br />to acquire the interest hereinafter specified in and to the <br />hereinafter described parcel of land situate in the City of <br />p ~ <br /> orksmouth, Virginia, for the purpose of constrncting, altering <br />and widening Wool Avenue. <br /> <br /> WHEREAS, the City of Portsmouth has not been able to <br />purchase the property described herein, necessary to the pro- <br />ject, because the owners thereof and the City have not been <br />able to agree upon the price to be paid therefor; and <br /> <br /> ~fHEREAS, advancement of the work and use of said pro- <br />ject will be delayed unreasonably if said property is not made <br />available as soon as possible. <br /> <br /> N01~, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Po~ · ~, <br /> ~tsmout~., Virginia; <br /> <br /> 1. The City Attorney is directed to institute eminent <br />domain proceedings against the following property situate in the <br />City of Portsmouth, for the purpose of acquiring fee simple title <br />therein, together with any and all easements of access, light or <br />air incident to the lands of the landowner abutting upon said <br />property, in accordance and pursuant to Sections 2.06, 2.07 and <br />2.08 of the Charter of the City of Portsmouth (Chapter 471 of <br />the Acts of Assembly of 1970, as amended), and to deoosit to <br />the credit of th~ Clerk of the Circuit Court of the City of <br />Portsmouth as provided by law the sum hereinafter specified to <br />compensate the owners of the parcel of land known, numbered and <br />designated as Parcel 2 as shown on that certain plat entitled <br />"Property To Be Conveyed To City Of Portsmouth For ~lt. Herman <br />Conservation And Devslopment Project VAR-69," dated July 2S, <br />1975, made by Baldwin & Gregg, LTD., reference to said plat <br />being made for a more particular description of the property. <br />A copy of said plat is attacheJ hereto. <br /> <br /> Name of the property owner Virginia Jones (Garrett) <br />and amount to be paid $21.OO. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a mee~n6 held August 19, 1975. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
