A RESOLUTION DIRECTING THE CITY MANAGER TO MAKE APPLICATION FOR A PEtLMIT FROM THE VIRGINIA DEPARTMEi~T OF HIGHWAYS AND TRANS- PORTATION TO REPROVE 318 ~ OF WIRE FENCE THAT IS USED TO MJtRK THE NORTHERN RIGHT-OF-WAY OF 1-264 BET~'USEN GREENWOOD DRIVE AND VICTORY BOULEVARD IN THE CITY OF PORTSMOUTH~ AND TO SIGN A BOND IN THE ~OUNT OF $i,000.00 FOR SAiD PROJECT. WHEREAS, it becomes necessary from time to time for the City of Portsmouth to obtain permits from the Virginia Department of Highways to instal!~ construct, reconstruct~ maintain and operate certain public works along, across- over and upon the highway system of Virginia; and WHEREAS, expense, damage or ~njury may be sustained by the Com.~onwealth of Virginia growing out of the granting to said City of Portsmouth by the Virginia Department of High- ways of s~id permits for the work aforesaid; and WHEREAS, one of the conditions of such permit or permits is that the City of Portsmouth shall indemnify the Commonwealth of Virglnla against all damages and injuries to the highways and bridges and to property lawfully upon such highways. NOW~ THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth~ Virg~n~a~ that the City Manager be, and he hereby is directed to make application for a permit from the Virginia Department of Highways and Transportation to remove 318' of wire fence that is used to mark the northern right of way of 1-264 between Greenwood Drive and Victory Boulevard in the City of Portsmouth, and to s~gn a bond in the amount of One Thousand and O0/1OO ($1,0OO~00) Dollars for the hereinabove mentioned project. BE IT FURTHER RESOLVED that the City Clerk is directed to forward a certified copy of this resolution to Virginia Depart- ment of Highways and Transportation.
