A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTS- MOUTH, 1973, AS ~'~ENDED, SUCH PROJECT BEING KNO~q AS LONDON OAKS AND DESIGNATED AS GHP-76-1. WHEREAS, Fralin and Waldron of Roanoke~ Virginia~ and its agent, Mills, Obenchain and Oliver, Inc. of Blacksburg; Virginia~ have made application pursuant to Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973f as amended, for the granting and approval for a group housing project known as London Oaks (GHP-76-!); and WHEREAS, the application for same has been deter- mined by the Planning Commissmon te have met the reouirements of Section 40-55 except as hereinafter stated; and WHEREAS, the Planning Commission has reviewed such application and the site plans submitted therewith and has recom/r.~ended approval of said application subject to the conditions hereinafter stated; and WHEREASr the developer has been informed that approval of a group housing project pursuant to said Section 40-55 of the Code of the City of Portsmouth grants only an exemption from certain dimensional requirements for residences as stated in said Section 4C-55 and does not constitute a waiver of any other requirements embodied in the Subdivision Ordinance, the Zoning Ordinance, the Code of the City of Portsmouth and any other applicable state or federal laws; and WHEREAS, the developer is aware that building permits and/or any cther required permit will be issued only upon compliance with ordinances or laws applicable thereto. NOW, THEREFORE~ BE iT RESOLVED by the Council of the City of Portsmouth, Virginia, that that certain group housing project known as London Oaks and designated as GHP-76-1 and more specifically shown on a plat entitled, "London Oaks, Portsmouth, Virginia", dated April 9, 1976, prepared by Milts~ Obenchain and Oliver, Inc. and attached hereto and made a part hereof is hereby granted approval subject ~o %he following conditions: (i) the perimeter thoroughfares Adequate buffer screens be provided around of the property ho shield residents from adjacent and commercial and industrial operations.
