125 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PRO- <br />PERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT <br />DOMAIN PROCEEDINGS PURSUANT TO CHA~TER 471 OF THE ACTS OF <br />ASSEmbLY, AS ~V~ENDED, SAID PROPERTY BEING NECESSARY FOR THE <br />CONSTRUCTION OF THE ELM'AVENUE - VICTORY BOULEVARD WATER <br />MAIN PROJECT (W-7). <br /> <br /> WHEREAS, the City of Portsmouth has found it <br />necessary to acquire the interest hereinafter specified <br />in and to the hereinafter described parcel of land situate <br />in the City of Portsmouth, Virginia, for the purpose of <br />constructing the Elm Avenue - Victory Boulevard Water Main <br />Project; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able <br />to purchase the property described herein necessary to the <br />project because the owners thereof and the City have not <br />been able to agree upon the compensation therefor; and <br /> <br /> WHEREAS, advancement of the work and use of the <br />said projeCt will be delayed unreasonably if said property <br />is not made available as soon as possible. <br /> <br /> NOW, TEEREFOP~E, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia: <br /> <br /> (1) That the City Attorney is directed to institute <br />eminent domain proceedings against the following property <br />situate in the City of Portsmouth, Virginia, for the pur- <br />pose of acquiring a perpetual right, privilege and ease- <br />ment of right of way in accordance with and pursuant to <br />Section 2.06, 2.O7 and 2.08 of the Charter of the City of <br />Portsmouth (Chapter 471 of the Acts of Assembly, ~970, <br />as amended), and to deposit to the credit of the Clerk of <br />the Circuit Court of the City of Portsmouth as provided by <br />law the sum hereinafter stated to compensate the owners <br />of the parcel of land designated on that certain plat en- <br />titled, Utility Easement To Be Acquired From Clifton <br />Forrest By City Of Portsmouth, Virginia", dated March 31, <br />1976 and prepared by R. Kenneth Weeks, Engineers And S. M. <br />Rogers, Engineer and Land Surveyor, a copy of said plat <br />is attached hereto. <br /> <br /> (2) The name of the property owner is: Clifton <br />Forres% and Mary E. Forrest. The amount to be paid is: <br />$4,550.00 <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held November 9, 1976. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
