123 <br /> <br />A RESOULTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PRO- <br />CEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS <br />AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, <br />ALTEP~TION AND WIDENING OF SYER ROAD. <br /> <br /> WHEREAS, the City of Portsmouth has found it <br />necessary to acquire the interest hereinafter specified in <br />and to the hereinafter described parcel of land situate <br />in the City of Portsmouth, Virginia, for the purpose of <br />constructing, altering and maintaining Syer Road; and <br /> <br /> WHEREAS, the City cf Portsmouth has not been <br />able to purchase the property described herein necessary to <br />the project, because of a defect in the title to the pro- <br />perty in that the location and status of the present record <br />owners cannot be determined; and <br /> <br /> WHEREAS, advancement of the work and use of said <br />project will be delayed unreasonably if said property is <br />not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of <br />the City of Portsmouth, Virginia, that the City Attorney be <br />directed to institute eminent domain proceedings against the <br />following property situate in the City of Portsmouth, Virginia, <br />for the purpose of acquiring feasible title therein, together <br />with any and all easements of access, light or air incident <br />to the lands of the lando%~ner abutting upon said property, <br />in accord~qce with and pursuan~ to Sections 2.06, 2.07 and <br />2.08 of the Charter of the City of Portsmouth (Chapter 471 <br />of the Acts of Assembly, 1970, as amended), and to deposit <br />to the credit of the Clerk of the Circuit Court of the City <br />of Portsmouth as provided by law the sum hereinafter specified <br />to compensate the owners of the parcel of land described as <br />follows: <br /> <br /> Beginning at a point on the southern <br />right-of-way of Gibney Street; said point <br />being S61°01'O1'' West 151.16 feet from-th~ <br />southwest intersection of Gibney Street and <br />Syer Road; thence along the southern right- <br />of-way of Gibney Street, South 61°01'O1" <br />West 9.01 feet to a point; thence S28°58'59~' <br />East 24.00 feet to a point; thence N8°24'13'' <br />West 25.64 feet to the Point of Beginning. <br /> <br /> The names of the property owner or owners are: <br />Bessie Small and Lonnie Small, Gertrude Hurdle, Beulah Walker, <br /> <br /> <br />
