111 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PRO- <br />CEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS <br />AM_ENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, <br />ALTERATION AND MAINTENANCE OF DEEP CREEK BOULEVARD. <br /> <br /> WHEREAS, the City of Portsmouth has found it nec- <br />essary to acquire interests hereinafter specified in and to <br />the hereinafter described parcel of land situate in the City <br />of Portsmouth, Virginia, for the purpose of constructing, <br />altering and maintaining Deep Creek Boulevard. <br /> <br /> WHEREAS, the City of Portsmouth has not been able <br />to purchase property described herein, necessary to the pro- <br />ject, because the owners thereof in the City have not been <br />able to agree upon price to be paid therefor; and <br /> <br /> WHEREAS, advancement of the work and use of the <br />said project will be delayed unreasonably if said property <br />is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council Of <br />the City of Portsmouth, Virginia: <br /> <br /> 1. The City Attorney is directed to institute <br />eminent domain proceedings against the following, property <br />situated in the City of Portsmouth, for the purpose of ac- <br />quiring fee simple title therein, together with any and all <br />easements of access, light or air incident to the lands of <br />the landowner abutting upon said property, in accordance and <br />pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of <br />the City of Portsmouth (Chapter 471 of the Acts of Assembly of <br />1970, as amended), and to deposit to the credit of the Clerk <br />of the Circuit Court of the City of Portsmouth as provided <br />by law the sum hereinafter stated to compensate the owners of <br />the parcel of land designated on that certain plat entitled, <br />"Plat of Deep Creek Boulevard Street improvement, Des Moines <br />Avenue to Wright Avenue", a copy of said plat is attached <br />hereto. <br /> <br />Jiggetts. <br />Virginia, <br /> <br />2.
