104 A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PRO- CEEDINGS PURSUANT TO CH_~PTER 471 OF THE ACTS OF ASSEMBLY, AS A_M~NDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, ALTERATION AND MAINTENA~[CE OF THE BEACON ROAD _~D ELLIOTT STREET PROJECT. WHEREAS, the City of Portsmouth has found it nec- essary to acquire interests hereinafter specified in and to the hereinafter described parcel of land situate in the City of Portsmouth, Virginia, for the purpose of constructing, altering and maintaining the Beacon Road and Etliott Street Project. WHEREAS, the City of Portsmouth has not been able to purchase property described herein~ necessary to the pro- ject, because the owners thereof in the City have not been able to agree upon price to be paid therefor; and WHEREAS, advancement of the work and use of the said project will be delayed unreasonably if said property is not made available as soon as possible. NOW, THEREFORE, BE IT RESOLVED by the Co~qcil of the City of Portsmouth, Virginia: 1. The City Attorney is directed to institute eminent domain proceedings against the following ~roperty situated in the City of Portsmouth, for the purpose of ac- quiring fee simple title therein, together with any and all easements of access, light or air incident %o the lands of the landowner abutting upon said property, in accordance and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of 1970, as amended), and to deposit to the credit of the ~l[erk of the Circuit Court of the City of Portsmouth as ~r~vided by law the sum hereinafter stated to compensate the o%~ers of the parcel of land designated as Parcel 6 on the plat entitled, "Plat Showing 30 Foot Sto~m Sewer Easement Acquired For Drainage Improvements To Various Areas Of The City Of Portsmouth", a copy of said plat is attached hereto. 2. The name of the property o?~er is: Leon F. and Edith. R. Houston. Adopted by the Council of the City of Portsmouth; Virginia, at a meeting held October 26, !976. Tests:
