103 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DO~4AiN PRO- <br />CEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS <br />AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, <br />ALTERATION AND MAINTENANCE OF THE BEACON ROAD AND ELLIOTT <br />STREET PROJECT. <br /> <br /> WHEREAS, the City of Portsmouth has found it nec- <br />essary to acquzre interests hereinafter specified in and to <br />the hereinafter described parcel of land situate in the City <br />of Portsmouth, Virginia, for the purpose of constructing, <br />altering and maintaining the Beacon Road and Elliott Street <br />Project. <br /> <br /> WHEREAS, the City of Portsmouth has not been able <br />to purchase property described herein, necessary to the pro- <br />ject, because the owners thereof in the City have not been <br />able to agree upon price to be paid therefor; and <br /> <br /> ~HEREAS, advancement of the work <br />said project will be delayed unreasonably if <br />is not made available as soon as possible. <br /> <br />and use of the <br />said property <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia: <br /> <br /> 1. The City Attorney is directed to institute <br />eminent domain proceedings against the following property <br />situated in the City of Portsmouth, for the purpose of ac- <br />quiring fee simple title therein~ together with any and all <br />easements of accessf light or air incident to the lands of <br />the landowner abutting upon said property, in accordance and <br />pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of <br />the City of Portsmouth (Chapter 471 of the Acts of Assembly of <br />1970, as amended), and to deposit to the credit of the Clerk <br />of the Circuit Court of the City of Portsmouth as provide~ <br />by law the sum hereinafter stated to compensate the q~er~ of <br />the parcel of land designated as Parcel 5 on the p~at entitled, <br />"Plat Showing 30 Foot Storm Sewer Easement Acquired For Drainage <br />Improvements To Various Areas Of The City Of Portsmouth", <br />a copy of said plat is attached hereto. <br /> <br /> 2. The name of the property owner is: J.E. <br />and Mary J.
