82 <br /> <br />A RESOLUTION GRA~TiNG A USE PEk~IT FOR OPERATING A PRIVATE <br />SCHOOL ON THE SOUTH SIDE OF PORTSMOUTH BOULEVARD BETWEEN <br />LP~NSING AVENUE AND FREDERICK BOULEVARD; SUSPENDING SECTION <br />2-t7(b) OF THE CITY CODE. (UP-76-9) . <br /> <br /> WHEREAS. Foundation Boy's Academy, Inc. has made <br />an application pursuan~ ~o Section 40-75(b} of the Code of <br />the Ci%v of Por~sme~th, Virginie~ 1873, for the granting of <br />a use eermit as hereinafter described: and <br /> <br /> WHE_~AS, the applicant and the Planning Director <br />have done all things required to be done in connection with <br />said application, and %he Planning Commission has recommend- <br />ed the granting of said use permit. <br /> <br /> NOW, THEREFOP~E, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia: <br /> <br /> A. That the use for which the use permit herein- <br />after described is sought: (1) Will not adversely affect <br />the health or safety of persons residing or working in the <br />neighborhood of the proposed use; (2) Will not be detri- <br />mental to the public welfare or injurious to property and <br />improvements to the neighborhood; and (3) Will be in accord <br />with the purposes of the Zoning Chapter of the City Code. <br /> <br /> B. The City of Portsmouth is hereby granting a <br />use permit pursuant to Section 40-75(b) of the City Code to <br />operate a private school on property described as follows: <br /> <br /> Beginning at a point which is approxi- <br />mately 120 feet southwest from the sohthwes~ <br />corner of Portsmouth Boulevard and Lansing <br />Avenue; thence southerly approximately 80 feet; <br />thence south approximately 280 feet; thence <br />east approximately 10 feet; thence south approxi- <br />mately 105 feet; thence east approximately 22 <br />feet; thence south approximately 425 feet; thence <br />east approximately 125 feet; thence south approxi- <br />mately 235 feet; thence southwest approximately <br />110 feet; thence northwest approximately 815 <br />feet; thence southwest approximately 300 feet; <br />thence northwest approximately 1005 feet; thence <br />northerly approximately 175 feet to the south <br />right-of-way line of Portsmouth Boulevard; <br />thence northeasterly along said right-of-way <br />approximately 1,760 feet to the Point O~ Beginning. <br /> <br />C.
