A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS ~ENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION OF THE EXTENSION OF THE SEAWALL AND THE NORTH [~RINA PURSUANT TO THE CRAWFORD HAP~OR WATERFRONT DEVELOPMENT PROJECT. WHEREAS, the City of Portsmouth has found it necessary to acqumre the interest specified in the hereinafter described parcel of land, situate in the City of Portsmouth, Virginia, for the purpose of con- structing the extension of the Seawall and the North Marina of the Crawford Harbor Waterfront Development Project. WHEREAS, negotiations have taken place with the owners of such property for the purchase thereof; no final agreement has been reached and the co~mencemenm of construction of the seawall and North Marina is to begin mmmediately. WHEREAS, advancement of the Crawford Harbor Development Project will be delayed unreasonably if such property ms not made a ' ~ vaml~ble as soon as possible. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: The City Attorney ms directed toinsumtute~' eminent domain proceedings if negotiations fa~l against the following property situate in the City of Portsmouth, for the purpose of acquiring fee simple title therein, in accord- ance and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of 1970, as amended), and to deposit to the credit of the Clerk of the Circuit Court of the City of Portsmouth as provided by law, the su~m hereinafter specified to compensate the owners of the parcel of land known, numbered and designated as Parcels Al, A2, and A3 as shown on that certain plat entitled, "Plat Showing Survey of Property for Crawford Harbor Project, Portsmouth, Virginia", dated April 9, 1976, made by Baldwin & Gregg, Ltd., reference to said plat being made for a more particular description of the property. A copy of said plat is attached hereto. The names of the property o%~ner are: Allen Fteder and Armond Caplan and the amount to be paid is $76,113.O0.
