73 A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CiTY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DO~IN PRO- CEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, EXPANSION ~ND I~ROVE~4ENT OF THE PINNERS POINT SEWAGE TREATMENT PLANT. WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinafter specified in and to the hereinafter described parcel of land situated in the City of Portsmouth, Virginia, for the purpose of constructing, improving and enlarging the Pinners Point Sewage Treatment Plant; and WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to the project because of a defect in the title to the pro- perty in that the present record owners cannot be located; and WHEREASi advancement of the work and use of said project will be delayed unreasonably if said property is not made available to the City. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Attorney is directed to institute Eminent Domain Proceedings against the following property situated in the City of Portsmouth, Vir- ginia, for the purpose of acquiring fee si/r~ple title therein, together with any and all easements of access, light.or air incident to the lands of the landowner abutting upon said property, ~n accordance with and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly, 1970, as amended), and to deposit to the credit of the Clerk of the Circuit Court of the City of Portsmouth, Virginia, as provided by law, the sum hereinafter specified to comoensate the owners of the parcel of land described as fol!~ws: Ail that certain tot~ piece or parcel of land, with the improvements thereon and the appurtenances thereto, belonging, situate, lying and being in the City of Portsmouth, Virginia, kno%.~n and designated as Lot 187 on the Plat of Portsmouth ~aterfront Land Company, ~ecorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia~ in Map Book 3, page 91.
