A RESOLUTION DIRECTING THE CITY ~NTtGER ~D APPLY FOR A PF~MIT FROM THE VIRGINIA DEPARKMENT OF HIG~E'~AYS A~R) TRANSPORTATION TO PERFOP~ ~i~RGENC~ REPAIR OF APPROXIMAT~ibY 800 £.'~T OF SANITARY SEWER LI~E BETW~:~:~ DES MOINES AVENUE A/O NORFOLK AND PORTS~OO~i~ BELTLIk~ RAILROAD IN THE RIGHT-OF-WAY OF IN'£TiNSTATE ROUTE 264, AA]D TO SIGN A BOND IN THE AMOL~ OF $1,000.00 FOR SAID PROJECT. WHEREAS, it becc~es necessary frc~ time to time for the City of Port~rDuth to obtain permits frc~ the V~rginia Depart/nent of Highways and Transportation to install, construct, reconstruct, main- rain and operate certain public works along, across, over and upon the highway system of Virginia; and WHEREAS~ expense, damage or .injury may be sustained by the Coan~r~ealth of Virginia growing out of the granting to said City of Portsmouth by the Virginia Dep~rtment of Highways and Transportation of said permits for the work aforesaid; and ~EREAS, one of the conditions of such permit or permits is that the City of Portsmouth shall indemnify the Ccm%monwealth of Virginia against all damages and injuries to the highways and bridges and to property lawfully upon such high%rays. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, directed to apply for a permit fr~ the Virginia Department of Highways and Transportation to perform emergency repair of approximately 800 feet of sanitary sewer line, and to sign a bend in the form attached hereto in the amount of One Thoussnd and 00/t00 (~l,OO0.O0) Dollars, for the hereinabove mentioned project° This resolution shall be effective from the date of its adopt- ion. Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held August 9, 1977. Teste: City Clerk
