A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXCHANGE <br />PROPERTY WITH THE VIRGINIA DEPARTMENT OF HIGHWAYS AND <br />TRANSPORTATION FOR DEVELOPMENT OF A SLUDGE DISPOSAL SITE <br />FOR THE PUBLIC UTILITIES DEPARTMENT. <br /> <br /> WHEREAS, the Portsmouth Public Utilities Department <br />is advised to obtain property located in the City of Suffolk <br />owned by the Virginia Department of Highways and Transportation <br />for the purpose of constructing a disposal site for sludge <br />and waste discharge from the water filtration plant; and <br /> <br /> WHEREAS, the Virginia Department of Highways and Trans- <br />portation desires to obtain property owned by the City of <br />Suffolk in the Lake Kilby watershed for the purpose of con- <br />structing the southwest bypass; and <br /> <br /> WHEREAS, the Charter of the City of Portsmouth, Section <br />2.09(c) provides that the City may convey property to the <br />Commonwealth of Virginla or any political subdivision there- <br />of without advertisement and without receiving bids. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the City ~nager be, and <br />he hereby is~ authorized to exchange the hereinafter described <br />property with the Virginia Department of Highways and Trans- <br />portation, subject to the conditions and restrictions stated <br />herein, for the purpose of development of a sludge disposal <br />site for the Public utilities Department .... <br /> <br /> The property to be conveyed to the Virginia Department <br />of Highways And Transportation is described as follows: <br /> <br />PARCEL I <br /> <br /> Ail that certain tract, piece or parcel <br />of land, situate, lying and being in the City <br />of Suffolk, Virginia, (formerly Holy Neck <br />Megisterial District, Nansemond County, Vir- <br />ginia), bounded and described as follows: <br /> <br /> Beginning at a point on Lake Kilby be- <br />ing a corner between the lands of the Ports- <br />mouth, Berkeley and Suffolk Water Company and <br />Martha A. Benton, wife of Samuel B. Benton, <br />thence by a line of marked trees South 82° <br /> <br />45' east 114.7' to a point; thence South 83~ <br />07' east 49.0' to a poplar; thence South 83° <br />07' east 139.O' to a sweet gum; thence south <br />83° 07' east 115.6' to a point; thence South <br />82° 08' east 266.2' to a gum; thence South <br />83° 16' east 158.3' to a dogwood; thence South <br /> <br /> <br />
