23 <br /> <br />A RESOLUTION TO PRO-V-/DE FOR THE ACQUIS~I'If~ OF C~R~ALN PROP~RT~ BY THE <br />CITY OF PORTSMOUth, VIRGINIA, UNDER ~[NENT DC~AIN PROCEh~INGS PURSUANT <br />TO CHAPT~L~ 471 OF THE ACTS OF ASS~LY, 1970, AS ~4~DED, SAID PROPERTY <br />BEIh~ NECESSARY FOR CONSTRUCTION AND EXPANSION OF THE PORT FACILITIES <br />IN P/NNERS POINT. <br /> <br /> B~EREAS, the City of Portsmouth has found it necessary %o acolyte <br />the interest hereinafter specified in and to ~he hereinafter described <br />parcel of land situate in the City of Portsmouth, virginia, for the <br />purpose of constructing and expanding the port facilities in Pinners <br />Point; and <br /> WHEREAS, the City of Portsmouth bas not been able to purchase the <br />property described herein, necessary3' to %he projec~, because all of the <br />present record owners of said property cannot be locate~, tht%~, creating <br />a defect in the record title of said property; and <br /> WHEREAS, theadvancament of the werk and use of said p~oject will <br /> be delayed umreasenably if said property is not made available as soon <br /> as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br /> Portsmouth, Virginia, that the City Attorney be, and he hereJDy is, <br /> directed to institute eminent domain proceedir~s against the following <br /> described property situate in f/qe City of Portsmou~-h~ Virginia, for <br /> the purpose of acqu/ring fee simple title therein, together ~th any <br /> and all easements of access, light or air incident to the lands of <br /> the landowner abutting upon said property in accordance with and pur- <br /> suant to Sections 2.06, 2.07 and 2.09 of the Char%er of ~Jle City of <br /> Portsmouth (Chapter 471 of the Acts of Assembly~ 1970, as ar~nded) and <br /> to deposit to the credit of the Clerk of the Ci~cui-~ Court of the City <br /> of porh~mouth, Virginia, as provided by law, the sram here/~nafter <br /> specified to compensabe the ova/ers of the p~rcel of land. <br /> The name of the property owners s=~e: William W. Dew, _~iriam Estelle <br /> Dew Smith, Richard R. Dew, Bertha F. Shawn, Id~ _Mae King, Elsie L. Dew, <br /> 'Joseph E. Dew, Jr., Thomas L. Dew, Rosser M. Dew, Jr. and Lawrence V.
