38 <br /> <br />A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO INSTITUTE APPROPRIATE <br />LEGAL PROCEEDINGS TO ENFORCE THE PROVISIONS OF THE OLDE TOWNE CON- <br />SERVATION PROJECT (VA.R-49) PERTAINING TO UNDERGROUND UTILITIES. <br /> <br /> WHEREAS, the conservation plan for Olde Towne Conservation <br />Project (VA.R-49) as amended February, 1976, provides that all <br />utilities within the project area shall be placed underground and <br />all serv!ce connections to users of such utilities shall be under- <br />ground; ~nd <br /> <br /> WHEREAS~ the City has expended $360,000 to provide easements <br />and to locate underground electric~ gas and telephone service with- <br />in the conservation district; and <br /> WHEREAS, some 27 structures within the conservation district <br />have failed to change over to underground service thereby requiring <br />the maintenance of dual overhead and underground utility systemS; <br />and <br /> <br /> WHEREAS, the Olde Towne District has been designated as a <br /> historic area by the Virginia Historic Landmarks Commission and <br /> Portsmouth City Council; and <br /> <br /> WHEREAS, the.histori~ characteristics of the Olde Towne <br /> District will be better preserved by a uniform system of under- <br /> ground utilities. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br /> Portsmouth, Virginia, that the City Attorney be, and he hereby is, <br /> authorized to institute appropriate legal proceedings to enforce <br /> the provisions of the 01de Towne Conservation Project (VA.R-49) as <br /> amended February, 1976, pertaining to underground facilities. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br /> at a meeting held May 8, 1979. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
