12 <br /> <br />A RESOLUTION EXPRESSING THE CONSENT OF COUNCIL TO THE VACATION <br />AND RELEASE OF A CERTAIN DRAINAGE EASE~ENT CALLED HULL STREET; <br />AUTHORIZING THE CiTY MANAGER TO SIGN RELEASE AGREEMENT. <br /> <br /> W-~EREAS, the City of Portsmouth was granted a certain <br />drainage easement over and across property now owned by Hallmark, <br />Inc., known, numbered and designated as Lot 133 on the Plat of <br />North Truxton; and <br /> <br /> WHEREAS, certain permanent improvementshave been made upon <br />said property which encroach upon the aforementioned drainage <br />easement; and ~ <br /> <br /> WHEREAS, ~he owners of said property have agreed to convey <br />additional property for the relocation of sai~ easement and to pay <br />the cost of relocating the pipe therein in-exchange for release of <br />existing drainage easement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the Council hereby expresses its consent <br />to the vacation and release of the existing drainage easement as <br />shown on that certain plat entitled~ "Plat Showing Ten Foot Drainage <br />Easement Across Lot 133, Plat of North Truxton, Portsmouth, Virginia" <br />dated January 18, 1979, prepared by E. Stuart Ball and Associates, <br />Ltd., a Copy of which is attached to this resolution for more <br />particular description of said easement. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and hereby <br />is, authorized to sign an easement agreement declaring'the vacation <br />and release of said easement and dedicating additional property for <br />relocation of the existing drainage line. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at <br />a meeting held February 13, 1979. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
