S. i-' ~ ~.-.- - '- PROTEL'i'ION AGENCY. <br /> <br /> ~7HEREAS, the regulations promulgated by the Envirorm~ntal Protection <br />Agency to establish criteria in acting upon applications for issuance of <br />a National Pollutant Discharge Etimn~hion System (NPDES) permit %~b_ich <br />modifies the requirement of secondary treatment under Section 301 (h) <br />of the Clean Water Act required tt~ filing of application within ninety <br />(90) days of the effective date of the regulation; and <br /> <br /> BT~, the City was unaware of the deadline for the preliminary <br />application and was advised by consultants that it was impossible ~o <br />prepare a full application witkin the ninety (90) day time limit; and <br /> <br /> WHEREAS, studies indicate tJ~at upgrading to secondary treatment by <br />the existing plants with outfalls in the Elizabeth River would have no <br />appreciable effect on the quality of that body of water; and <br /> <br /> W~, it is estimated that the City can achieve approximately <br />the same treatment c/,~14ty of its effluent without going completely to <br />secondary treatment, thus, saving the Federal taxpayers and the Portsmouth <br />utility customers approximately $16,000,000. in capital cost and a <br />substantial amount in annual operating expenses; and <br /> <br /> ~EREAS, it would be irresponsible for the City of Portsmouth to <br />blindly pursum the up-grading of our secondary water plant with ~]l 1 <br />knowledge that the taxpayer and customer is not receiving a oorres- <br />ponding be~nefit. <br /> <br /> R~DW, ~-%~TRE, BE iT RESOLVED by the Council of the 'City of Ports- <br />mouth, Virgir~'a, that this Council endorses the City's request for a <br />waiver of the ninety (90) day requirement for acceptir~ an aD_pticatien <br />for modification of the secondary treatment plant requirements so that <br />complete doCumentation of the City's alternate approach can be prepared. <br /> <br /> Adopted lrt the Council of the City of Portsmouth, Virginia, at a <br />meeting_ held December 11, 1979. <br /> <br />Ci~ Clerk <br /> <br /> <br />
