<br /> ~r~AS, by the petitions submitted in accordance with Section
<br />15.1240~ Code of Virginza, certain abutting landowners have petitioned
<br />the Cit~v of Po~uth to construct a sidewalk Ln ~an!ey Street abutting
<br />80, 82~ 84, 86, 88, 90, 92, 94 and 96 on the south sid~ of -~nley Street
<br />and 81, 83, 85, 87, 89~ and 91 on t_he no~th side of M~nley Street and
<br />2739 on the south side of Portsmouth Boulevard, v~aere standard sidewafuks
<br />do not exist; and
<br />
<br /> ~{EP~AS, notice has been duly given to the abutting landowners, as
<br />provided by Section 15.1240, Code of V~_rginia, tb~t a hearing would be
<br />held before the Council of the City of Portsmouth on November 13, 1979,
<br />at 7:30 p.m., mn the Comncit (/aambers thereof; and

<br /> ~K{EREAS, said hearing has been duly held ~nd in judgment of Council
<br />the said sidewalk should be constructed.

<br /> NOW, ~RE, BE IT RESOLVED by ~he Cotmcit of the City of
<br />Portsmouth, Virginia:

<br /> 1. That the construction of a sidewa3_k in the street abutting 80,
<br />82, 86, 88, 90, 92, 94 and 96 on the souhh side of Manley Street and 81,
<br />83, 85, 87, 89, ~mad 91 oD_ the north side of M2malel/ Street and 2739 on
<br />the sou~h side of Portsmouth Boulevard, where standard sidewalks do not
<br />now exist, is h~n~eby au~herized.
<br />
<br /> 2. '~at ~e abutting landowners shall be assessed at the rate of
<br />$3.00 per front lineal fcot pursuant to a petition signed by seventy-
<br />five (75%) percent of the property owners sffected ks~ the requested
<br />improvements.
<br />
<br /> 3. That f_he Cit-y~ Clerk shall fomT/nwith cause to be recorded an
<br />abs~-ract of t~his resolu~-ion, together with a staten~zat sh~ng the
<br />onwers~hip a_nd location of the property to be affected ~ the proposed
<br />sidewalk and the estimated amount that will be assessed against such
<br />abutting landc~er Ln accordance with a statememt of such ~nount on file
<br />in the Office of the- ~y Clerk.
