42 A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY AN EASEMENT ON CITY-OWNED PROPERTY TO THE CITY OF SUFFOLK, VIRGINIA (LAKE KILBY SHORES). WHEREAS, the City of Suffolk desires to install a sewage force main over, under and across certain here- inafter-described property owned by the City of Portsmouth; and WHEREAS, the installation of said sewage force main will not be in conflict with the operation of public utility facilities of the City of Portsmouth; and WHEREAS, Section 2.O9(c) of the Charter of the City of Portsmouth provides that the City may convey property to the Commonwealth of Virginia or any political subdivision thereof, without advertisement and without receiving bids; and WHEREAS, the City of Suffolk is a municipal corporation of the Commonwealth of Virginia. NOW, THEREFORE, BE IT RESOLVED by the Cou.ncil of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to convey a free, perpetual and exclusive easement and right-of-way over, under and across the hereinafter-described property for the purpose of con- structing, renewing and repairing a sewage force main. All that certain piece or parcel of land situate in the City of Suffolk, Virginia, shown on that certain plat entitled, "Plat Showing Easement For City Of Suffolk Kilby Shores Force Main From City Of Portsmouth", dated January 30, 1980, prepared by Hassell & Folkes, P.C., Surveyors & Engineers, Ports- mouth, Virginia, a copy of said plat being attached hereto for a more particular de- scription. BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to complete all transactions and execute all documents incident to such conveyance.
