A RESOLUTION C=RANTING A ~USE PEP~IT TO MT. OLIVA~ BAPTIST ~L~T ~ OP~ A ~ ~ ~U~TI~L ~T~ ON BY ~G S~ ~ ~ NOR~, ~ S~ ~N ~ ~T, ~ ~f4ERFAS, Mt. Olivet Baptist f/mmrch, by Chairmsn of %he Deacon Board, Jasper L. Kindred, and architect, Heshel Laster, m~de appli- cation pursuant to Seotion 40-71 lb) of the Code of the City of Ports- muth, Virginia, 1973, as amended, for the granting of a use permit as hereinafter-described; and W~, the applicant and f-he Planning Director have done all things r ~equired to be done in connection with said a?plication; ~nd ~q~, the Planning Cc~a~ission has reccr~mmaded %he granting of said use pemmit. N~J..~, ~RE, BE. IT RESOLVED by the Council of ~ City of Ports- mutt, Virginia: (i) ~qat t~he use for wh±ch the use permit hereinafter is sought: (a) Will not adversely affec~ ~ health and safety of persons residing or working ~-n the neighborhood of the propose~ use; ~b) Will not be detrimental %o the public use or injurious the property or ~rovemen~s in the neighborhood; and lc) Will be Ln accord w~th the purposes of the Zoning Chapter of the City Code. (2) Mt. Ol±vet Ba~rfclst Church is h~reby granted a use permit pursuant to Section 40-7100) of the Code of the City of Portsmouth~ V~rginia, to operate a church ~nd educational building at the property described as folly;s: Beginning at the northwest corner of B_~p!e Street and County Street; thence west along the north right- of-way of Coun%7_/ S~reet to the east right-of-way of Phoeb~ Street; ~hence north along sai~ right-of-way %o the so,att right-of-way of t~ng S~reet; thence east along said right-of-way to the~ v~st right-of-way of ~le Streat; theace south along said right-of-way to Coan~¢ Street, the point of origin. (3) ~is use permit is approved subject to the following condition: (1) The use permit would be consid~red revoked unless buitdLng permits are issued and constructzon under way within one (1) year.
