A RESOLUTION AUTH~OILIZtNG THE CITY M~ZAG~q ~ ~.i~ INTO A LICE~..~E AGRE~- <br />M~ W±'i'H SEABOI~RD COAST LINE RAILROAD CO~PALrf FOR INST~ATffATION OF <br />LI~. <br /> <br /> I%~qEP~AS, the City of Portsmouth obtained certain prOpe_rty located <br />in the City of S~ffolk, Virginia, for construction of a di ~sposal facility_ <br />for sludge generated at the Lake Kilby Water Plant; and <br /> <br /> [~AS, the location of this disposal facility requires the con- <br />struction of a force main to transport the materiaL-frc~ Lake Kitby to <br />the site; and <br /> <br /> I~aS, the force main to be constructed will be partially located <br />on property of the Seaboard Coast Line _Railroad Compan~v; and <br /> <br /> W~i.'~EAS, the City of Port~mouth end Seaboard Coast Line Railroad Com- <br />pany have negotiated a license agreement for the construction and main- <br />tenance of said force main on the property of the railroad. <br /> <br /> NOW, THtZEFO_RE, ~E IT RESOLVED by the Council of the City of Ports- <br />~Outh, Virginia, that the City ~nager be, and he hereby is, authorized <br />to enter into a license agreement with Seaboard Coast Line Railroad Company <br />for the construction, maintenance, repair, renewal, operation, use and <br />removal of a force i~3~n frc~ Lake Kilby to the disposal facility. <br /> <br /> Adopted by the Cottncil of the City of Portsmouth~ Virginia, at a <br />meeting held J~nua~f 8, 1980. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
