88 A RESOLUTION GRANTING A USE PERMIT TO SHERMAN DeBERRY CLUB, INC. TO OPERATE A PRIVATE FRATERNAL SOCIAL CLUB PURSUANT TO SECTION 40-75(b) OF THE CITY CODE AT THE PREMISES DESIGNATED AS 3025 PORTSMOUTH BOULEVARD. WHEREAS, the Sherman DeBerry Club, Inc. by Raymond L~ Ballard, President, made an application pursuant to Section 40-75(b) of the Code of the City. of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by ~he Council of the City of Portsmouth, Virginia: i. That the use for which the use permit hereinafter- described is sought: (a) Will not adversely affect the safety of the persons residing or working in of the proposed use; health and the neighborhood (h) Will not be detrimental to the public use or injurious to the property and improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. That the Sherman DeBerry Club, Inc., by Raymond L. Ballard, President, is hereby granted a use permit pursuant to Section 40-75(b) of the City Code to operate a private fraternal social club on property hereinafter-described: Beginning at the southeast corner of Portsmouth Boulevard and Grand Street; thence east along the south right-of-way of Ports- mouth Boulevard 50'; thence south 119.76'; thence west 50' to the east riqht-of-way of Grand Street; thence north along said right- of-way 120.24' to Portsmouth Boulevard, the Point of Origin; the premises being designated as 3025 Portsmouth Boulevard.
